Wat is de WPO precies?

De Wet van 18 mei 2024 tot regeling van de private opsporing (WPO) moderniseert het juridisch kader voor private onderzoeksactiviteiten in België en vervangt de vroegere wetgeving inzake privédetectives. De wet is van toepassing op een brede waaier van actoren die onderzoeksactiviteiten uitvoeren, waaronder ook interne onderzoeksdiensten binnen ondernemingen.

De WPO legt strikte voorwaarden op inzake vergunningen, onafhankelijkheid en professionele integriteit, en introduceert een duidelijker normatief kader voor de uitvoering van onderzoeken. Een belangrijke vernieuwing is de expliciete verankering van de beginselen van proportionaliteit en subsidiariteit, evenals de versterkte aandacht voor de bescherming van persoonsgegevens en de naleving van de GDPR.

Daarnaast bevat de wet meer gedetailleerde bepalingen inzake toegelaten onderzoeksmethoden, het gebruik van technische hulpmiddelen, en de verplichte documentatie en rapportering van onderzoeksactiviteiten, met bijzondere aandacht voor de keten van bewaring (chain of custody).

De WPO beoogt aldus een evenwicht te waarborgen tussen de noodzaak van efficiënte en professionele fraudedetectie en -onderzoek enerzijds, en de bescherming van de fundamentele rechten en vrijheden van betrokken personen anderzijds.

 

LRP, c'est quoi exactement?

La loi du 18 mai 2024 réglementant la recherche privée (LRP) modernise le cadre juridique applicable aux activités de recherche privée en Belgique et remplace la législation antérieure relative aux détectives privés. Elle s’applique à un éventail élargi d’acteurs, y compris les services d’enquête internes au sein des entreprises.

La loi impose des conditions strictes en matière d’agrément, d’indépendance et d’intégrité professionnelle, et introduit un cadre normatif plus précis pour la conduite des enquêtes. Parmi les évolutions majeures figure l’intégration explicite des principes de proportionnalité et de subsidiarité, ainsi qu’un renforcement des exigences en matière de protection des données à caractère personnel, en conformité avec le RGPD.

Elle prévoit également des dispositions plus détaillées concernant les méthodes d’enquête autorisées, l’utilisation de moyens techniques, ainsi que les obligations de documentation et de rapportage, avec une attention particulière portée à la chaîne de conservation des preuves (chain of custody).

La loi vise ainsi à assurer un équilibre entre l’efficacité des investigations et la protection des droits fondamentaux des personnes concernées.

 

Internal investigation policy

The Belgian Private Investigation Act (WPO) has now been published in the Official Gazette and is currently in force. A key requirement under the WPO is that all companies must implement an internal investigation policy, in accordance with Article 65, in order to conduct investigations involving employees.

To support consistency and ease implementation, the Institute of Fraud Auditors (IFA) has developed a model policy, accompanied by practical guidelines to help organisations make well-informed, legally sound choices. Both documents were prepared by a consortium of law firms (Everest Law and Lydian) and subsequently validated in practice by the Compliance & Fraud Risk Management department of Finvision.

Position paper

The Institute of Fraud Auditors (IFA), in cooperation with the ACFE Belgium Chapter, has recently finalised a jointly approved position paper on the practical application of the Belgian Private Investigation Act of 18 May 2024, which will be made publicly available on both organisations’ websites and presented to the Ministry of the Interior to support a constructive dialogue on key operational challenges in the field.

In this context, both organisations will also raise the urgent issue of the absence of implementing Royal Decrees regarding training and licensing requirements, which currently impacts workforce deployability and raises concerns regarding the continuity and effective implementation of legally compliant private investigation activities.
